It is a common belief that there are no non-violent, marijuana offenders serving sentences of Life Without Parole in the United States.  Even though most people believe that this does not happen, at the other end of the spectrum there are many who believe that this category of inmates may be in the hundreds of thousands

The first 9 inmates featured have received life without parole in the federal system, are over 60 years of age,  have served an average of 19 years of their sentences, and 8 exercised their right to trial.

Life without parole is not frequently given for marijuana-only non-violent offenses.  We believe that the individuals spotlighted here are the victims of CHARGING DISPARITY.

The first 9 inmates are all over 60 years of age and have served over 15 years of a sentence of life without parole for non-violent, marijuana only offenses They all exercised their sixth amendment right and went to trial.

John has been in prison since 1996.  Held till his trial in 2000.  Sentenced in Jan. 2001.  John has completed many courses 
since his incarceration.  Since 2003 he has been a mentor helping inmates adjust to incarceration and counseled on use of 
time and productivity.  
2006 John entered the Mentor Program for the challenge  program.    John Teaches and develops ACE continuing education classes.
John is a steady calming presence for many younger inmates.

He has developed and taught classes dealing with alternative building and living techniques.  These courses are taught with the theme Simple is better.  Material is based on small dwellings and green building.  He develops and organizes the curriculum.
John assists teaching four PE conditioning classes:  Swiss Ball,  Flexibility and Agility, Plyo Medicine Ball,  Over 50 + Cardio and Strength,  and Spin Class.

Paul has taken many courses since entering the prison system. He has completed writing classes writing esssays and short stories.
He has taken US History, World History, Intro to Latin Culture, Legal Research, Microsoft Office and Word Excel.

Paul Free is a 60 year old inmate who has been in prison for 16 years. 
 This is his story.

Paul received his BS in Biology from SUSU.  He has taught GED classes and had the highest % of successful graduated in the prison system.  He has had special satisfaction teaching older inmates to read.

Eugene is 68 years old.  He received a BA from Farleigh Dickinson University where he was student council president.  He joined the Peace Corp and worked in the Barrios in Venezuela.  When he returned he worked in the jState Department and was the youngest Capital Development    officer with the USAID in Nicaragua.  He left to work as a securities analyst in New York.

Eugene and family moved to Florida where he started a data processing business and a ship brokerage firm.  He has been in prison for 21 years.  

While in prison Eugene has completed a masters degree in Economics from Antioch.  Eugene teaches writing and has written screen plays, poetry and essays.  He is a strong Catholic and his faith has sustained him.

Larry Duke has been incarcerated for 22 years.  He is a non-violent marijuana only offender with a sentence of life without parole.  Larry has continued his interest in tinkering and creating and problem solving during his time in prison.  He has been told that he is the only federal prisoner who currently holds a US patent.  

Larry is also one of the few life without parole inmates who is a decorated  Viet Nam combat veteran.  He served with Delta Company  1st Battalion, 7th Marine Regiment 1965-1966.  Larry served his country with honor  and distinction.

Billy Dekle has completed many valuable educational courses since his incarceration.  Among the many courses are microsoft office, finance, english, computer concepts U.S.P.O.  and various physical fitness programs. 


Billy is 61 and  has been incarcerated for over 20 years for a non-violent, marijuana only offense.  He was born in Gainesville. FL in 1949 and grew up on a farm on New River.  He attended Lake City Community College.  Billy has many supporters working for  his release and reform of sentencing laws.

Leopoldo is a 73 year old Cuban fisherman.
He has been inprisoned for 19 years for carrying
marijuana on his fishing boat on two occasions.
He is in poor health and would like to be with 
his family again.

Leopoldo received a sentence of Life Without Parole
as a non-violent, marijuana prisoner.  Leopoldo has
a wife, four children, and three grandchildren who
would like to have him ohome.
Claude Louis Duboc 01434-112

Claude Duboc is a French National who has been incarcerated since 1994.  Claude has applied to be repatriated back to France as provided for in the French/Americo Prisoner Transfer Treaty.  He submitted his third application for transfer in September 2010.  He has been denied twice and may apply every two years.  The Ministere de la Justice Francaise has sent a letter  to repatriate him, but the US Government has not complied.

Profile:  Undergraduate: University of Colorado,  Post-Graduate: Masters in Economics:  London School of Economics - supplemented with summer courses at the Sorbonne  (Paris).  Within USP-Tucson he has taught French for Beginners,  those of Middle Proficiency, and Advanced  French classes.  Advises on an ad hoc basis questions of Economics when called upon.

Albert was tried in the Northern District
of Florida in 2000.  He was sentenced to 
Life without parole by Judge Maurice Paul.
Albert is a non-violent, marijuana only
offender.

Charles Cundiff

Andrew Cox

Andrew was Tried in the 11th Circuit in 2008.  
He was sentenced to life without parole as a Non-Violent,Marijuana only offender.  
He had two prior minor manrijuana only offenses. 
Both ot these were also non-violent. 
This was a conspiracy case.  
Andrew was a Fire Fighter and owned several businesses: 
restaurant, used car lot, gas station, trucking company, and wholesale warehouse.

In 2008 Andrew went to trial.  A witness told the 
Agents that all the marijuana belonged to Andrew.
Andrew had a wife and three children aged 17, 15
and twelve.  He lived in a small town in the mountains 
of Northeast Georgia.  He still has appeals.

Andrew plays handball, runs, and makes leather crafts.

Randy Lanier

Randy has been imprisoned for 23
years for a marijuana offense.  When
he was indicted his daughter was
7years old and his son was 7 months.

Michael Pelletier

Michael has been confined to a wheelchair since chilehood.  In 2008 he was sentenced to Life
Without Parole. He is the fourth child of ten born to Alphy and Dorothy Pelletier.  
He is 55 years of age.

  When Michael was 11 years old he was run over by a tractor while working on his father's potatato farm. 
He was  paralyzed and has been a level T-7 paraplegic since that time.  Michal was always described as very 
bright and extremely well liked.  Michael's father is 85 years of age and served in WWII.  
He has two sisters who served in the Marines. 


Michael was sentenced to LWP for a non-violent
marijuana only offense in the Federal Court in Maine.

 His trial was in 2008 and he received the sentencing enhancement for exercising his right to trial rather than accepting a plea.

Prior to being sentenced, Michael was a Certified Watchmaker who received his certification from the Bulova School of Watchmaking. He was also a Certified Diamond Setter.

In prison Michael spends his time oil painting, shooting pool, playing chess and the guitar.  Michael is hoping to begin a writing project.

The picture is of Maurice and his Dad.  His father is 73 years old and would like to have his son home.  Maurice has a wife and no children.  He is 38 years old.  Maurice was sentenced to 27 1/2 years for a marijuana only offense in April of 2003.  He is working on a bachelor's degree in sociology and has completed 29 college credits. 

Prior to his incarceration, Maurice worked at the family owned racetrack in Pennsylvania.  He worked in maintenance and general operations.  All of his co-defendants received between 8 months and 7 years.  He was sentenced to 27 1/2 years.
Craig W Frazier

Craig is 44 years old and has a de facto life sentence as a non-violent, marijuana only offender.
Craig was sentenced to 40 years in Federal Prison, and his projected release is 2042.
He did not accept a plea, but opted to exercise his right to trial.

Craig  was born in Great Falls Montana.  He has three children, a daughter and two sons.
He has a brother and sister and lots of supportive family and friends.  Prior to his conviction, Craig worked in the catering business catering for conventions.  He is in good health, and has good conduct reports.

Richard DeLisi

Richard has three children and one brother.  He was sentenceed for conspiracy to traffic in marijuana.
There was no violence associated with his crime.  He received three consecutive 30 year sentences.  
This is a 90 year de facto life sentence.

Richard was sentenced beyond the guidelines of the crime.  Guidelines are 12 to 17 years.
He is in poor health and is 62 years of age.  Richard occupies his time in prison taking classes from Cabinet Making to Bibile Study to Self Improvement Programs.

George is serving his 26th year of a life sentence.  George      has written and published extensively since his incarceration.  He has a published book about growing up in his     Italian- American neighborhood in Philadelphia.  He writes essays   and poetry,


George teaches inmates reading and writing, teaches yoga, and counsels suicidal inmates.  He has no incident repots.  George has been an inspiration to  the many inmates he has taught and counseled.

Kenny has been in prison since 1993, and was tried and sentenced in 1994.  He has no incident reports in his 16     years in prison.  Kenny  is a Viet Nam War Hero and has been featured in Prison Fellowship Ministry Journal.  He has three purple hearts and a bronze star.  Kenny and his wife were     active members of their farm community and church.  


Kenny's wife was on the board of the American Diabetes Association.  He provided jobs in his construction business, and donated time and landscaping to Habitat for Humanity.

Kenny is working on a Restorative Justice Project to help others who are being released.  He is finding mentors  and working with the BOP in developing a program that will identify those deserving inmates who are most likely not to be recidivate.
